Terms of Service

1. Acceptance of terms
By accessing or using any Foundry Apps product or website (collectively, "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms form a legally binding agreement between you and Foundry Apps Ltd, a company registered in Guernsey, Channel Islands.
2. Description of service
Foundry Apps provides software products delivered via the web. Our current products include:
- Orbit — a real-time space mission tracker covering launches, the International Space Station, and destinations across the solar system.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where practicable.
3. Accounts
Some features require you to create an account. You are responsible for:
- Providing accurate and current registration information.
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
You must be at least 16 years old to create an account. Notify us immediately at david@foundryapps.co.uk if you suspect unauthorised access to your account.
4. Payment and subscriptions
Paid features are offered on a subscription or one-time purchase basis. All payments are processed by Paddle, who acts as Merchant of Record. By purchasing, you also agree to Paddle's terms of service.
- Subscription fees are billed in advance on a monthly or annual cycle.
- Prices are displayed inclusive of applicable taxes.
- You may cancel your subscription at any time; access continues until the end of the current billing period.
- Refunds are handled in accordance with Paddle's refund policy and applicable consumer law.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorised access to any part of the Service or its infrastructure.
- Scrape, copy, or redistribute content from the Service without our prior written consent.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to transmit spam, malware, or harmful content.
We reserve the right to suspend or terminate accounts that violate these restrictions.
6. Intellectual property
All content, software, designs, and materials within the Service are the intellectual property of Foundry Apps Ltd or our licensors, and are protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for your personal, non-commercial purposes. You may not reproduce, modify, distribute, or create derivative works without our express written permission.
7. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or harmful components. You use the Service at your own risk.
8. Limitation of liability
To the fullest extent permitted by law, Foundry Apps Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including loss of data, revenue, or profits.
Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or £50, whichever is greater.
9. Termination
We may suspend or terminate your access to the Service at any time for breach of these Terms, or for any other reason at our discretion, with reasonable notice where practicable. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will do so.
10. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes by email or via a notice on our website at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by and construed in accordance with the laws of the Bailiwick of Guernsey. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Guernsey, unless otherwise required by applicable consumer protection law.
